Beneficiary Appointment
A depositor aged 18 years and above is required to appoint a nominee among his / her heirs according to the Shariah Law, to whom the amount or part of the amount in the depositor’s account will be paid after the demise of the depositor (references - Lembaga Tabung Haji Act 1995, Lembaga Tabung Haji Regulations (Deposits and Withdrawals) 2002, Amendment 2003, Amendment 2013 and Amendment 2017).
A nomination is a written declaration made by a TH depositor to appoint or nominate any one of his / her heirs in accordance with the Shariah Law as a “Nominee”. The appointed individual will act as an executor or administrator of the depositor’s savings in TH upon the demise of the depositor.
The list of heirs according to the Shariah Law is as follows:
Male Heirs
- Male children.
- Male grandchildren (offspring of a male child) and below.
- Father.
- Paternal grandfather and above.
- Male siblings from the same parents.
- Male siblings from the same father.
- Male siblings from the same mother.
- Nephews (male offspring of siblings from the same parents).
- Nephews (male offspring of siblings from the same father) and below.
- Uncles (brothers of any parents from the same grandparents).
- Uncles (brothers of any parents from the same grandfather).
- Children of an uncle (brother of any parents from the same grandparents).
- Children of an uncle (brother of any parents from the same grandfather).
- Husband.
Female Heirs
- Female children.
- Female grandchildren (offspring of a male child).
- Mother.
- Maternal grandmother.
- Paternal grandmother.
- Female siblings from the same parents.
- Female siblings from the same father.
- Female siblings from the same mother.
- Wife.
Purpose
The purpose of appointing a nominee is to facilitate the withdrawal of the deceased’s savings without a Power of Attorney or Order from the relevant parties (Land Offices, Shariah Courts, Amanah Raya Berhad).
Nominations must be made by a depositor while he/she is still alive using the Nomination Form made available by TH and submitting it at any TH offices in order to be registered into TH’s system. The effective date of a nomination is on the day the form is received and registered.
A nomination is void under the following circumstances (references - Lembaga Tabung Haji Act 1995, Lembaga Tabung Haji Regulations (Deposits and Withdrawals) 2002, Amendment 2003, Amendment 2013 and Amendment 2017):
- Upon the demise of a nominee, or if there is more than one nominee, upon the demise of all nominees, while the depositor is still alive;
(meaning: all nominees are deceased while the depositor is still alive).
- Relating to the interest of the nomination of any nominee, upon the demise of the nominee while the depositor is still alive, except when the interest of the nominee has been made void by the nominator;
(meaning: the depositor made a new nomination while is still alive by submitting the form required by TH).
- With a written cancellation submitted by a depositor and received by TH while the depositor is still alive; or
(meaning: a depositor, while is still alive cancels a nomination that was made by submitting the form required by TH).
- With a nomination made later in accordance with sub-regulation (3) by a depositor who cancelled an earlier nomination.
(meaning: a depositor made a change of nominees while is still alive by submitting the form required by TH).
